A hearing was held on March 5 in which Diane’s new attorney was granted permission by the court to file an amended complaint. This new complaint sets out various instances where it alleges that the county did not follow the law when the Board of County Commissioners adopted the MSBU on September 27 2016. You can view that complaint below. On March 14 another hearing was held, and the trial that was originally set for April 23 was continued to October 1. This extension was requested because of the fact that a new attorney was hired to replace Diane’s previous attorney that had to withdraw for medical reasons. While attorneys on both sides usually agree to extensions in such cases out of courtesy, the attorneys for the county and the intervenors opposed the extension, but the judge granted it anyway. So the process to prepare for trial will continue.
